Terms and Conditions

Please read the below carefully. These terms and conditions will tell you who we are, details of how you receive our products, any changes that may be made to our agreement and other important information.

1. Information about us and how to contact us

2. Our agreement

An agreement is made between us once the quote has been accepted and the order has been placed. The order can be placed via email or phone with a GP Watercraft staff member. If we are unable to accept your order you will not be charged. Your order may be unaccepted due to stock level, error in price or incorrect product description

3. Right to make changes

It’s within our rights to make changes in line with law and relevant regulations. Once an order has been confirmed and you wish to make changes, these must be in writing. We will let you know if it is possible to make the changes requested. Changes may affect delivery time, price of product or stock. We will make you aware of any changes and ask you to confirm that you still wish to go ahead with the change. Any changes that we make that are unacceptable to you, may mean that you may like to terminate the agreement. More details below under “termination of agreement”

4. Delivery terms

Delivery terms which include estimated date and cost will be quoted on the customer quote received during the sales process. Due to stock availability and arrival of products from outside the UK, delivery may be delayed due to circumstances outside of our control. We will communicate any changes that affect delivery date as soon as possible.

All products are delivered to Eastern Rd, Portsmouth, PO3 5LY, where the products must be collected by the customer. Should you wish to have the boat delivered to a different UK address, this can be arrived by a third party organisation at your discretion. Our agreement is for the product to arrive at Eastern Rd, Portsmouth, PO3 5LY only.

5. Ending the agreement

5.1 When collecting products from Eastern Rd, Portsmouth, PO3 5LY, if products are damaged or incorrect you have the right to terminate this agreement.

5.2 We do not take any responsible for damage caused to the products through incorrect installation or set up by customer.

5.3 “Cooling-off period” – You have a legal right to change your mind within 14 days of receiving the product and receive a full refund. This does not apply to bespoke products. Products can only be returned if they are unused and in their original packaging.

5.4 To end the agreement with us for any reason stated above this must be in writing. Please email [email protected] with name, address, details of order and contact number. If you cancel your order after you have received the products they must be returned to us at your cost.

5.5 Any refunds will be made to you as soon as possible at the price paid, using the same method used for payment

7. Payment terms

The price will be sent to you by email or online quote which shows the cost of product plus VAT. Once you have confirmed your order you will be asked to pay a 20% deposit. We accept payment through online bank transfer. The remaining balance is due prior to or on the date of collection.

9. Our responsibility for loss or damage suffered by you if you are a consumer

9.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

9.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products

10. Our responsibility for loss or damage suffered by you if you are a business

10.1 Nothing in these terms shall limit or exclude our liability for:

(a) death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);

(b) fraud or fraudulent misrepresentation;

10.2 (a)  we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and

(b)  our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the purchase price of the product.

11. Other Important terms

11.1 We are GP Watercraft Ltd, a company registered in the UK. Our company registration number If any element of these terms and conditions are found to be invalid, the rest of the of the terms and conditions will remain unaffected.

11.2 This agreement is between us and you and no other third party shall have any rights to enforce this agreement

11.3 We remain the right to enforce this contract. Even if we do immediately insist on any action required by you under these terms, that does not mean that we will not enforce these actions at a later date.

11.4 Both parties acknowledge that we must not rely on any statement, representation, assurance or warranty that is not included in this agreement

11.5 We may update these terms and conditions without prior notice. The terms and conditions that are provided at the time of purchase are the relevant terms and conditions for the purchase of that product
